The State of New Hampshire, Department of Safety, Office of the Commissioner, Bureau of Hearings has a full-time vacancy for Chief Hearings Examiner-Attorney IV, SOC Title 23-1010 LAWYERS-5. This position has a 37.5-hour work week and is considered exempt.
SUMMARY: Serves as senior legal counsel and oversees a legal unit of four or more full-time legal staff to address legal, regulatory, legislative, and/or enforcement objectives and activities for a state agency.
YOUR EXPERIENCE COUNTS: Each additional year of approved formal education may be substituted for one year of required work experience and/or each additional year of approved work experience may be substituted for one year of required formal education.
MINIMUM QUALIFICATIONS:
Education/Experience:
Equivalent combination of 14 years of education and experience after completion of high school. Education and experience must include the active practice of law demonstrating knowledge of civil procedure, administrative law, and application of federal and state statutes and regulations.
License/Certification:
Valid driver's license or access to transportation for statewide travel.
Other Requirements:
Selected candidate will undergo a fingerprint based criminal background check and motor vehicle record check in order to ensure suitability for exposure to confidential information.
Must be an active member of the New Hampshire Bar Association and in Good Standing.
RESPONSIBILITIES:
Manages a legal unit, directing and overseeing the work of four or more full-time legal staff, which includes two or more, hearing officers/examiners, or senior attorneys. Assist the Administrator of Hearings in the administrative and operational functions of the Bureau of Hearings.
Oversees the conduct of administrative and other hearings. Serves as hearing officer/examiner when needed. Reviews evidence and legal briefs. Determines liability, sanctions, or penalties, or recommends acceptance or rejection of claims.
Represents the agency in a senior capacity as required and directed by the Commissioner or similar agency leader. Coordinates with the Attorney General's Office and other state and federal entities as needed. Explains and defends agency decisions, goals and objectives.
Represents the Director of Motor Vehicles in hearing appeals; prepares and presents the State's case before the Superior Courts when a decision made by a Hearings Examiner is appealed. Drafts pleadings, motions, interrogatories, discovery, preparing witnesses, and presenting evidence.
Ensures agency compliance with applicable state and federal laws and rules, executive orders, collective bargaining agreements, and court or board decisions.
Monitors compliance with administrative decisions, court orders, or other actionable obligations including collection activities related to civil penalties and enforcement actions inclusive of seeking injunctive relief in court.
Manages the preparation and review of orders, decisions, policies, protocols, guidelines, forms, procedures, requests for proposals/bids, contracts, legislation, rules, or other documents with legal implications.
Directs research of files, statistics, data, court abstracts, legal briefs, and court decisions to determine trends and inform agency decisions regarding policy, rules, legislative or enforcement actions.
Maintains professional appearance, maintains harmonious work relationships, and treats all contacts with courtesy, respect, and utmost professionalism.
